Terms of Use

1. Purpose and acceptance

These terms of use (the "Terms") govern the use of the Proofit mobile application (the "Application") and the services it offers (the "Service"). They form a contract between you (the "User") and the publisher of the Application.

By creating an account, you acknowledge that you have read and unconditionally accept the Terms, together with our Privacy Policy. If you do not accept them, do not use the Application.

2. Publisher

The Application is published by Qore Games, a simplified joint-stock company (SAS) with share capital of €1,000, registered with the Paris Trade and Companies Register under number 949 296 313 (SIRET 949 296 313 00024), with its registered office at 9 rue des Colonnes, 75002 Paris, France (the "Publisher", "we", "us").

3. The Service

Proofit allows you, in particular, to:

  • create private circles or join them by invitation (code or link), with up to 12 members;
  • set a weekly activity goal and track your circle's progress, streak of successful weeks and badges;
  • post a proof photo for each activity, which members can react to and comment on;
  • use an excuse (token) to count a day without exercise, which circle members can tease you about ("roast");
  • suggest and vote on a weekly forfeit, send a friend a wizz to motivate them, or take a break;
  • if you give permission, the Application may read your workouts in Apple Health or Health Connect so you can attach them to your photos.

The Service is provided free of charge, except for the in-app purchases described in Article 9. We may change its features at any time.

4. Account

To use Proofit, you must be at least 15 years old. If you are a minor, you confirm that you have the consent of a person with parental responsibility.

You sign in with Apple, Google or your phone number. You agree to provide accurate information, use only one account, refrain from impersonating others and keep access to your account confidential. You are responsible for activity on your account.

You can delete your account at any time from Profile > Delete my account. Your photos, activities, reactions and comments are then permanently deleted. Circles you administered are transferred to the longest-standing member.

5. Rules of conduct: zero tolerance

Proofit is built on trust between friends. No objectionable content or abusive behaviour is tolerated. You must not post, send or suggest any of the following, including in a comment, roast, excuse, forfeit, circle name or profile photo:

  • nudity, sexual content or any content involving a minor in an inappropriate way;
  • harassment, intimidation, threats, insults or mockery targeting someone's appearance, weight, origin, religion, gender, sexual orientation, disability or health;
  • hateful, discriminatory or violent statements, or statements glorifying violence;
  • someone's photo or data without their consent, or private information about others;
  • illegal or misleading content, spam or advertising;
  • content that infringes the rights of others (image rights, copyright or trademarks).

Roasts

Roasts are friendly teasing about an excuse. They must remain kind and never target the person themselves. The person being teased can respond, report or block.

Forfeits

Forfeits are friendly challenges chosen by circle members. Proofit does not impose or control them and does not organise any betting or monetary stakes. A forfeit must remain lawful, safe and reasonable: it must not require anyone to consume alcohol or any other substance, put someone in danger, humiliate them or make them incur a significant expense. Everyone remains free to decline.

Wizz and notifications

A wizz is intended to encourage, not harass. It is limited to one per friend per day, and members who are taking a break do not receive any.

Physical activity

Exercise safely and in accordance with your physical condition. Never put yourself in danger to reach a goal, maintain a streak or avoid a forfeit.

6. Reporting, blocking and moderation

To protect everyone, the Application allows you to:

  • report a photo, comment or member from its menu;
  • block a member: you will no longer see their posts or comments, and they will no longer be able to send you a wizz;
  • leave a circle at any time; a circle administrator can remove a member;
  • write to us at [email protected] about any problem.

We review every report within 24 hours. If content breaches the Terms, we remove it and may suspend or delete its author's account, without notice or compensation, depending on the seriousness or repetition of the conduct. We may also remove manifestly unlawful content on our own initiative and cooperate with authorities when required by law.

If content you posted has been removed or your account has been suspended, you can challenge the decision by writing to us at [email protected]; we will review the situation again.

7. Your content

You retain ownership of the photos, text and other content you post (the "Content"). You warrant that you hold the rights to it and have the consent of the people who can be recognised in your photos.

To operate the Service, you grant us a non-exclusive, royalty-free, worldwide licence to host, reproduce, technically adapt (format, compression) and display your Content solely to members of the circles in which you post it, for as long as it remains published. We never use your Content for advertising without your express consent.

You can delete a post at any time, which also deletes its reactions and comments. If you share an activity outside the Application (Share feature), that sharing is subject to the terms of the service you choose.

8. Health

Proofit is not a medical device and does not provide medical advice. The statistics displayed (duration, calories, heart rate, distance) are for information only.

If you give permission, the Application reads your workouts in Apple Health (HealthKit) or Health Connect. It does not write anything to them. A workout's statistics are attached to your photo only if you choose to do so; they are then visible to circle members. Your health data is never sold or used for advertising or commercial purposes. You can withdraw your permission at any time in your phone's settings.

9. In-app purchases

Additional excuses can be purchased in the Application. These are consumable digital content, paid for through Apple's App Store or Google Play under those platforms' terms; the price is shown before you confirm a purchase. An excuse is credited to your account as soon as the platform confirms payment.

Excuses have no monetary value, cannot be refunded, exchanged or transferred, and are lost when the account is deleted. An excuse can only be used once per day per circle.

As the content is supplied immediately, you expressly request performance upon purchase and acknowledge that you lose your right of withdrawal (Article L221-28, 13° of the French Consumer Code). Refund requests are handled by Apple or Google under their rules.

Subscriptions taken out in an earlier version of the Application remain managed by the purchasing platform: you can cancel them at any time in your Apple account or Google Play settings.

10. Intellectual property

The Application, its brand, design, text, sounds, illustrations, badges and code are protected and belong to the Publisher or its partners. We grant you a personal, non-exclusive and non-transferable licence to use the Application for your private use. You may not copy, modify, decompile or commercially exploit it.

11. Availability and liability

We do our best to keep Proofit running continuously, but cannot guarantee this: the Service may be interrupted for maintenance, updates or a service provider outage.

Each User is responsible for the Content they post. As a hosting provider, we are not liable for Users' Content until it has been reported to us, and we act promptly to remove content that is manifestly unlawful.

To the extent permitted by law, we cannot be held liable for indirect damage, loss of data or streaks, or forfeits agreed between members. Nothing in the Terms limits our liability for gross negligence or intentional misconduct, for personal injury, or the rights you have under consumer law.

12. Suspension and termination

You can stop using Proofit and delete your account at any time. We may suspend or delete an account that breaches the Terms (Article 6), or that remains inactive for more than 24 months after notifying you. We may also discontinue the Service by giving Users at least 30 days' notice.

13. Personal data

We process your personal data in accordance with the GDPR and the French Data Protection Act (loi Informatique et Libertés). Details of the data we process, its purposes, retention periods and your rights are set out in our Privacy Policy. To exercise your rights, contact us at [email protected].

14. Changes to the Terms

We may change the Terms, for example to reflect changes to the Service or the law. We will inform you of any significant change in the Application at least 15 days before it takes effect. If you continue using Proofit after that date, you accept the new Terms; otherwise, you can delete your account.

15. Governing law and disputes

The Terms are governed by French law. If you reside in another European Union country, you retain the protection of the mandatory rules of your country of residence.
